Gin Amber Beauty offers a monthly subscription program that sends you a dermaroller of your selected size and/or other products. To begin, choose the subscription option to receive a discount and add it to your cart. There is no registration fee, and you may cancel after a minimum of three (3) recurring orders. If you choose to create an account, you agree to provide and maintain accurate, current, and complete information as prompted by the Gin Amber Beauty registration form. Your registration data and certain other information are governed by our Privacy Policy.

You may cancel your Gin Amber Beauty subscription after a minimum of three (3) subscription orders by logging into your account. There is no cancellation fee. Please note that your account can only be canceled by an Official Gin Amber Beauty Representative, the registered account holder, or the holder of the valid credit card on file.

SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS

Gin Amber Beauty (referred to as "We," "Us," or "Our") offers a mobile messaging program (the “Program”), which you agree to use and participate in according to these Mobile Messaging Terms and Conditions and our Privacy Policy (the “Agreement”). By opting into or participating in any of our programs, you accept and agree to these terms, including your agreement to resolve any disputes through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to alter any other Terms and Conditions or Privacy Policy governing your relationship with Us.

User Opt-In: The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting in, such as through online or application-based enrollment forms. By joining, you consent to receive marketing messages at the phone number associated with your opt-in. Consent is not required for any purchase from Us. While you consent to receive autodialed messages, this should not imply that all messages are sent via an automatic telephone dialing system (ATDS or "auto dialer"). Message and data rates may apply.

User Opt-Out: To discontinue participation or if you no longer agree to this Agreement, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. You may receive a confirmation message of your decision to opt out. You agree that these are the only reasonable opt-out methods. Other methods, including verbal requests, are not valid means of opting out.

Duty to Notify and Indemnify: If you intend to stop using the mobile number associated with the Program, you agree to complete the Opt-Out process before ending your use. Failure to notify Us of any changes to your mobile number will hold you responsible for any costs (including attorneys’ fees) or liabilities incurred by Us due to claims by subsequent users of the mobile number.

Program Description: Users opting into the Program can expect messages regarding the marketing and sale of products, services, and events.

Cost and Frequency: Message and data rates may apply. The Program includes recurring mobile messages, with additional messages sent periodically based on user interactions.

Support Instructions: For support, text “HELP” to the number you received messages from, or email us at info@ginamber.com. Opt-outs must follow the procedures above.

MMS Disclosure: SMS messages will be sent if your device does not support MMS messaging.

Disclaimer of Warranty: The Program is offered “as-is” and may not be available in all areas at all times. We are not liable for delays or message failures. Message delivery is subject to your wireless provider’s network performance, which is beyond our control.

Participant Requirements: You must have a wireless device capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular providers support the necessary services to participate.

Age Restriction: The Platform is not for use by individuals under thirteen (13). If you are between thirteen (13) and eighteen (18), you must have parental or legal guardian permission. By using the Platform, you confirm you are not under thirteen (13), or have the necessary permission, or are an adult in your jurisdiction.

Prohibited Content: You agree not to send any prohibited content, including but not limited to:

• Fraudulent, defamatory, threatening, or harassing content
• Objectionable content (e.g., profanity, violence, discrimination)
• Malware or harmful code
• Any unlawful promotions
• Content protected by HIPAA or HITEC unless legally permissible

Dispute Resolution: Any disputes, claims, or controversies between you and Us, including statutory claims, will be resolved by arbitration in Miami, Florida, according to the Commercial Arbitration Rules of the AAA. Arbitration will be before one arbitrator with at least five years’ experience. This arbitration agreement follows the Federal Arbitration Act and does not permit class arbitration.

Miscellaneous: You represent and warrant that you have all necessary rights to agree to these Terms. Failure by either party to exercise rights under this Agreement does not waive further rights. If any provision is invalid, that provision will be limited to the minimum extent necessary, and the Agreement will otherwise remain in full force. We reserve the right to modify these Terms. Any updates will be communicated to you, and continued participation after changes indicates acceptance of the updated Agreement.
